Terms of Service

Last updated: December 15, 2024

Please read these terms and conditions carefully before using the Service.

1. Introduction

Welcome to OpenMeet Survey! These Terms of Service govern your use of the OpenMeet Survey platform (the "Service") operated by OpenMeet. By accessing or using the Service, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use the Service.

2. Definitions

  • Service refers to OpenMeet Survey, accessible at survey.openmeet.net
  • User refers to anyone using the Service, whether logged in with ATProto or as a guest
  • Survey refers to polls and questionnaires created through the Service
  • Response refers to votes and answers submitted to surveys
  • ATProto refers to the AT Protocol, the decentralized social networking protocol used by Bluesky
  • PDS refers to Personal Data Server, your ATProto data storage

3. Account and Authentication

  • You may use the Service without an account (as a guest) or by logging in with your ATProto identity
  • Guest users can create surveys and vote but data is stored only on our servers
  • ATProto users benefit from data portability—surveys and responses are stored on your PDS
  • You are responsible for maintaining the security of your ATProto account

4. Use of the Service

You agree to use the Service in accordance with all applicable laws and these Terms. You may not:

  • Use the Service for illegal or harmful activities
  • Create surveys containing harassment, hate speech, or illegal content
  • Attempt to manipulate survey results through automated means or vote fraud
  • Circumvent vote-once protections or rate limits
  • Use the Service to collect sensitive personal information without consent
  • Impersonate others or misrepresent your identity

5. User-Generated Content

  • You retain ownership of surveys and content you create
  • By creating a survey, you grant the Service permission to display and aggregate responses
  • For ATProto users, surveys are stored on your PDS—you control this data
  • You are responsible for ensuring your content does not violate the rights of others
  • We reserve the right to remove content that violates these terms

6. Survey Responses

  • Responses are displayed anonymously—we show vote counts, not voter identities
  • Text responses to free-form questions may be displayed in results
  • ATProto users: responses are stored on your PDS and can be deleted by you
  • Guest users: responses are stored on our servers and contribute to aggregate counts

7. ATProto Integration

  • The Service integrates with ATProto for identity and data storage
  • ATProto data is inherently public on the AT Protocol network
  • We use custom lexicons (net.openmeet.survey.*) for survey data
  • Data portability is a feature—your surveys travel with your PDS

8. AI-Generated Content

If you use the AI survey generation feature:

  • Generated surveys are suggestions and should be reviewed before publishing
  • You are responsible for the final content of surveys you create
  • AI generation is subject to rate limits and usage quotas

9. Service Availability

  • The Service is provided "as is" without guarantees of uptime or availability
  • We may modify, suspend, or discontinue features at any time
  • We will make reasonable efforts to notify users of significant changes

10. Intellectual Property

  • The Service software, design, and branding are property of OpenMeet
  • Survey content belongs to the creators
  • ATProto and Bluesky are trademarks of their respective owners

11. Termination

  • We may suspend or terminate access for violations of these terms
  • You may stop using the Service at any time
  • ATProto users retain their data on their PDS even after stopping use

12. Limitation of Liability

The Service is provided "as is" without warranties of any kind. OpenMeet shall not be liable for any damages arising from your use of the Service, including but not limited to direct, indirect, incidental, punitive, or consequential damages.

13. Indemnification

You agree to indemnify and hold OpenMeet harmless from any claims, damages, or losses arising from your use of the Service or violation of these terms.

14. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised terms.

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which OpenMeet operates.
